You authorize us to share the information you submit with funding providers, service providers, and other parties as described in our Privacy Policy in order to evaluate and process your request.

You are responsible for the accuracy of everything you submit. Providing false information may result in denial of your request, termination of access to the site, and referral to appropriate authorities.

By providing your phone number, email address, or other contact information, you consent to be contacted by Simply Advance and the funding providers we work with by phone, text message, email, or automated dialing technology at the numbers and addresses you provide, including for marketing purposes. Consent is not a condition of receiving financing. Message and data rates may apply. You may opt out of marketing texts by replying STOP and marketing emails by using the unsubscribe link or by emailing us.

The site and all of its content — including text, graphics, logos, trademarks, images, layout, and software — are owned by Simply Advance or its licensors and are protected by United States and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the site for your own business purposes. All other rights are reserved. The Simply Advance name and logo may not be used without our prior written permission.

The site may contain links to, or content from, third parties. We do not control third parties and are not responsible for their content, products, services, privacy practices, or security. Your dealings with any third party, including any funding provider, are solely between you and that party.

The site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on the site is complete, current, or accurate.

To the maximum extent permitted by law, Simply Advance and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising out of or related to your use of the site, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the site will not exceed one hundred dollars ($100).

You agree to indemnify, defend, and hold harmless Simply Advance and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the site, your submissions, or your breach of these Terms or of any applicable law.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in Richmond County, New York, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one year after it arises. To the extent permitted by law, you waive any right to a trial by jury and to participate in a class action.

We may update these Terms at any time by posting a revised version with a new “Last updated” date. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
